Schedules of Indian Constitution

                   अनुसूचियाँ
मूल संविधान में 8 अनुसूचियाँ थी। वर्तमान में अनुसूचियों की संख्या 12 है। जो निम्नलिखित है। जैसे-
ü पहली अनुसूची- राज्य व संघ राज्य क्षेत्र। इसमें भारत के 28 राज्य और 8 संघ राज्य क्षेत्रों का उल्लेख है।
ü दूसरी अनुसूची- इसके अन्तर्गत प्रमुख पदधिकारियों ( राष्ट्रपति, राज्यपालों लोकसभा अध्यक्ष व उपाध्यक्ष, राज्यसभा सभापति व उपसभापति, विधानसभा के अध्यक्ष व उपाध्यक्ष, विधानपरिषद के सभापति व उपसभापति, उच्चतम न्यायालय और उच्च न्यायालयों के न्यायाधीशों तथा नियन्त्रक महालेखा परीक्षक) को प्राप्त होने वाले वेतन, भत्ते, पेंशन आदि का उल्लेख है।
ü तीसरी अनुसूची-  इसके तहत संसद के सदस्यों व संघ के मंत्रियों, उच्चतम न्यायालय तथा उच्च न्यायालयों के न्यायाधीशों , राज्य विधानमण्डल के सदस्यों व मंत्रियों तथा नियन्त्रक महालेखा परीक्षक को दिलाये जाने वाले शपथ का प्रारूप दिया गया है। अनुच्छेद 60 के तहत राष्ट्रपति अनुच्छेद 69 के तहत उपराष्ट्रपति तथा अनुच्छेद 159 के तहत राज्यपाल द्वारा ली जाने वाली शपथ का प्रारूप प्रदत्त है।
ü चौथी अनुसूची- इसके अन्तर्गत भारत के सभी 28 राज्यों तथा 2 संघ राज्य क्षेत्रों के राज्यसभा में प्राप्त प्रतिनिधित्व का विवरण दिया गया है। राज्यसभा की कुल 245 सीटों में से 233 सीटें विभिन्न राज्यों को आवंटित है। जिसमें सर्विधिक 31 सीटें उत्तर प्रदेश को प्राप्त है।
ü पाँचवी अनुसूची- इस अनुसूची के अन्तर्गत अनुसूचित क्षेत्रों और अनुसूचित जनजातियों के प्रशासन  व नियन्त्रण के बार में दिया गया है।
ü छठवीं अनुसूची- इसके तहत असम, मेघालय, त्रिपुरा, और मिजोरम के जनजाति क्षेत्रों के प्रशासन के बारे में उपबंध किया गया है।
ü सातवीं अनुसूची- इसमें संघ और राज्यों के मध्य शक्तियों के विभाजन के बारे में दिया गया है। इसके अन्तर्गत निम्नलिखित तीन अनुसूचियाँ है, यथा- संघ सूची, राज्य सूची, समवर्ती सूची।  संघ सूची में कुल 97 विषयों(वर्तमान में 100) का उल्लेख है, जिस पर विधि बनाने का अधिकार केवल संघ को है। राज्यसूची में कुल 66 विषय (वर्तमान में 61) है, जिन पर विधि बनाने का अधिकार राज्य को है। समवर्ती सूची में कुल 47 विषय (वर्तमान में 52) है, जिन विधि बनाने का अधिकार संघ व राज्य दोनों को है।
ü आठवीं अनुसूची- मूल रुप से आठवीं अनुसूची में कुल 14 भाषाएँ थी, वर्तमान में इसके अनर्तगत 22 भाषाएँ है। 1967 ईस्वी में सिंधी को (21वें संविधान सेंशोधन द्वारा), 1992ईस्वी में कोकणी, नेपाली तथा मणिपुरी को (71वे संविधान संशोधन द्वारा) तथा सन्2004 में संथाली डोगरी मैथली तथा बोडो को  (92वे संविधान संशोधन द्वारा) आठवीँ अनुसूची में शामिल किया गया।
ü नौवी अनुसूची- इसमें कुछ अधिनियम और विनियमों के विधिमान्यकरण का उपबन्ध किया गया है।इस अनुसूची में सम्मिलित विषयों को न्यायलय में चुनौती नही दी जा सकती है। वर्तमान में इस अनुसूची में कुल 284 अधिनियम है। यह अनुसूची संविधान के प्रथम संविधान संशोधन द्वारा संविधान संशोधन अधिनियम 1952 में जोड़ा गया है।
ü दसवीं अनुसूची- इसमें दल-बदल से सम्बन्धित प्रावधानों का उल्लेख किया गया है। इसे 52वे संविधान संशोधन अधिनियम 1985 में जोड़ा गया है।
ü ग्यारहवी अनुसूची- इसमें पंचायतों को शक्तियाँ तथा प्राधिकार प्रदान किया गया है। जिसके अन्तर्गत पंचायतों को कार् करने के लिए कुल 29 विषय प्रदान किये गये है, इसे 73वे संविधान संशोधन अधिनियम 1992 द्वारा जोड़ा गया।
ü बारहवी अनुसूची- इसमें नगरपालिकाओं की शक्तियों का उल्लेख है। इसके अन्तर्गत शहरी क्षेत्र की स्थानीय निकायों को कार्य करने के लिए 18 विषय प्रदान किये गये है। यह अनुसूची 74वें संविधान संशोधन अधिनियम 1992 द्वारा जोड़ी गयी।
Schedules
The original constitution had 8 schedules. There are currently 12 schedules. as written below. like-
ü   First Schedule - States and Union Territories. It mentions 28 states and 8 union territories of India.
ü Second Schedule - Under this, the Chief Officers
 (President, Governors, Lok Sabha Speaker and
 Deputy Speaker, Rajya Sabha Chairman and 
Deputy Chairman, Legislative Assembly 
Speaker and Deputy Speaker, Chairman and
 Deputy Chairman of Legislative Council, Judges
 and Comptroller and Auditor General of Supreme 
Court and High Courts) Pay, allowances, pension
 etc. are mentioned.
ü Third Schedule - Under this, the format of 
oath to be given to the members of Parliament
 and Union Ministers, judges of the Supreme 
Court and High Courts, members and ministers
 of the State Legislature and the Comptroller 
and Auditor General. Under Article 60, the 
President provides the format of oath to be 
taken by the Vice- President under Article 69
 and the Governor under Article 159.
ü Fourth Schedule- Under this, the details of 
representation received in Rajya Sabha of all 
28 states and 2 union territories of India are 
given. Out of the total 245 seats in Rajya 
Sabha, 233 seats are allotted to different states.
 In which Uttar Pradesh has got 31 seats.
ü  Fifth Schedule - Under this schedule is 
given about the administration and control 
of scheduled areas and scheduled tribes.
ü Sixth Schedule- It provides for the
 administration of the tribal areas of Assam, 
Meghalaya, Tripura, and Mizoram.
ü Seventh Schedule - It gives about the
 division of powers between the Union and the
 States. Under this, there are the following three 
schedules, viz. Union List, State List, Concurrent
 List. A total of 97 subjects (currently 100) are 
mentioned in the Union list, on which only the 
Union has the right to make laws. There are a
 total of 66 subjects (currently 61) in the state 
list, on which the state has the right to make
 laws. There are a total of 47 subjects (currently 
52) in the concurrent list, both the Union and 
the State have the right to make laws.
ü Eighth Schedule - Originally there were 
14 languages ​​in the Eighth Schedule, currently
 there are 22 languages ​​under it. Sindhi was 
included in the Eighth Schedule in 1967 (by the
 21st Constitution Amendment), Kokani, Nepali
 and Manipuri in 1992 AD (by the 71st 
Constitutional Amendment) and Santhali, Dogri, 
Maithili and Bodo (by the 92nd Constitution 
Amendment) in 2004.
ü Ninth Schedule - It provides for the validation
 of certain Acts and Regulations. The subjects
 included in this Schedule cannot be challenged
 in the court.At present there are a total of 284 
acts in this schedule. This schedule has been 
added to the Constitution Amendment Act 1952
 by the First Constitution Amendment of the 
Constitution.
ü  Tenth Schedule - It deals with provisions 
related to defection. It has been added to the 
52nd Constitution Amendment Act 1985.
ü Eleventh Schedule - In this Panchayats have
 been given powers and authority. Under which
 a total of 29 subjects have been provided to serve
 the panchayats, it was added by the 73rd
 Constitution Amendment Act 1992.
 -  Twelfth Schedule - It mentions the powers of 
municipalities. Under this, 18 subjects have been
 provided to the local bodies of urban areas to work.
 This schedule was added by the 74th Constitutional
 Amendment Act 1992.

राष्ट्रपति की कार्यपालिकीय, विधायी एवं आपातकालीन शक्तियाँ


राष्ट्रपति की शक्तियाँ (POWER OF PRESIDENT)
·    कार्यपालिका शक्तियाँ (EXECUTIVE POWER)- अनुच्छेद 53 के अनुसार, संघ की कार्यपालिका शक्ति राष्ट्रपति में निहित होगी ,जिसका प्रयोग वह संविधान के अनुसार स्वयं या अधीनस्थ पदाधिकारियों के माध्यम से करेगा। भारत में समस्त कार्यपालिका के कार्य राष्ट्रपति के नाम से ही किये जाते है,और सरकार के सभी निर्णय उसके निर्णय माने जाते है।
ü राष्ट्रपति को संघ के मामलों में सूचना प्राप्त करने का अधिकार है। संविधान के अनुच्छेद 78 के अनुसार यह कार्य प्रधानमंत्री को दिया गया है, जो राष्ट्रपति को सभी सूचनाओं से अवगत कराता है, जो राष्ट्रपति माँगता है।
ü अनुच्छेद 74 के तहत राष्ट्रपति को सलाह देने के लिए एक मंत्रिपरिषद् होगी, जिसका प्रमुख प्रधानमंत्री होता है।
ü राष्ट्रपति प्रधानमंत्री सहित अन्य प्रमुख व्यक्तियों की नियुक्ति करता है, जैसे-
संघ के मंत्रियों की

उच्चतम न्यायालय व उच्च न्यायालय के न्यायाधीश

ü राष्ट्रपति को संघ के कुछ अधिकारियों को पद से हटाने का भी अधिकार प्राप्त है, क्योंकि ये राष्ट्रपति के प्रसाद पर्यन्त अपना पद धारण करते है। जैसे-

राज्यों के राज्यपाल
भारत का महान्यायावादी
ü अनुच्छेद 160 के तहत राष्ट्रपति आकस्मिक परिस्थिति में राज्यपाल के कार्यों के निर्वहन हेतु उपबन्ध कर सकता है।
ü यूपीएससी के सदस्यों की संख्या, सेवा शर्तों तथा पदावधि सम्बन्धी विषय में विनियम बनाने का अधिकार राष्ट्रपति को प्राप्त है।
ü ऱाष्ट्रपति अपने नियुक्त किये गये प्रशासकों के माध्यम से केन्द्र शासित प्रदेश का प्रशासन संभालता है।
ü राष्ट्रपति किसी भी क्षेत्र के अनुसूचित या जनजाति क्षेत्र घोषित कर सकता है। जिसका प्रशासन वही संभलेगा।
ü राष्ट्रपति इन सभी शक्तियों का प्रयोग मंत्रिपरिषद की सलाह पर करता है।
·       विधायी शक्तियाँ (LEGISLATIVE POWER)- भारत का राष्ट्रपति संघ की कार्यपालिका का संवैधानिक प्रमुख होने के साथ संसद का अभिन्न अंग भी है। इसलिए राष्ट्रपति को विधायी शक्तियाँ भी प्राप्त है।
ü राष्ट्रपति को संसद का अधिवेशन बुलाने का अधिकार है। और वह सत्रावसान की भी घोषणा कर सकता है। परन्तु संसद के बैठकों के बीच 6 माह से अधिक का अन्तराल नही होना चाहिए। अतः राष्टरपति एक वर्ष में न्युनतम दो बैठक बुला सकता है। राष्ट्रपति को लोकसभा की नियत अवधि से पूर्व उसे भंग करने का अधिकार प्राप्त है।
ü राष्ट्रपति लोक सभा के प्रत्येक चुनाव के पश्चात प्रथम सत्र के आरम्भ में तथा प्रत्ये वर्ष प्रथम सत्र के आरम्भ में संसद के दोनों सदनों की संयुक्त बैठक को सम्बोधित करता है।
ü राष्ट्रपति को संसद के सदस्यों में अभिभाषण, सम्बोधन व संदेश देने का अधिकार प्राप्त है। (अनुच्छेद 86)
ü राष्ट्रपति संसद के दोनो सदनों में किसी साधारण विधेयक पर मतभेद होने पर दोनो सदनों की संयुक्त बैठक बुला सकता है, जिसकी अध्यक्षता लोकसभा अध्यक्ष करता है।
ü राष्ट्रपति को लोकसभा में (अनुच्छेद 331) दो आंग्ल भारतीय समुदाय और राज्यसभा में (अनुच्छेद 80) साहित्य, विज्ञान, कला और समाजसेवा के क्षेत्र में विशेष अनुभवी बारह आंग्ल भारतीय समुदाय के प्रतिनिधियों को मनोनीत करने का अधिकार प्राप्त है।
ü संसद द्वारा पारित विधेयक राष्ट्रपति के अनुमति से कानून बनता है। धन विधेयक और संविधान संशोधन विधेयक को छोड़कर अन्य विधेयकों को राष्ट्रपति पुनर्विचार के लिए लौटा सकता है। राष्ट्रपति के पास विधेयकों को रोकने के लिए अपनी वीटो पावर का भी प्रयोग कर सकता है।
ü जब राज्य विधानमण्डल द्वारा पारित किसी विधेयक को राज्यपाल राष्ट्रपति की अनुमति के लिए सुरक्षित रख लेता है, तो राष्ट्रपति विधेयक पर अपनी अनुमति दे सकता है अथवा नही भी दे सकता है या फिर राज्यपाल को पुनर्विचार के लिए विधानमण्डल में  भेजने का निदेश देता है। यह बात ध्यान देने योग्य है, कि यदि विधानमण्डल विधेयक को कुछ संशोधन कर या फिर संशोधन रहित पुनः राष्ट्रपति की अनुमति के लिए भेजता है, तो राष्ट्रपति विधेयक पर अनुमति देने के लिए बाध्य नही है।
ü कुछ विधेयकों को राष्ट्रपति के पूर्व सहमति से पेश किये जाते है, परन्तु बिना पूर्वानुमति के भी विधेयक पेश करने पर वो अमान्य नही घोषित किये जाते, परन्तु कुछ विधेयकों में राष्ट्रपति की पुर्वानुमति आवश्यक है, जैसे-
v धन विधेयक
v  नये राज्य के निर्माण या वर्तमान राज्य के क्षेत्र, सीमा व नाम में परिवर्तन करने वाले विधेयक
v  वह विधेयक,जो भारत में संचित निधि के व्यय से सम्बन्ध रखता है, किन्तु वह धन विधेयक नही है।
v भूमि अधिग्रहण सम्बन्धित विधेयक
v व्यापार स्वतन्त्रता को सीमित करने वाला राज्य का कोई विधेयक
v कराधान से सम्बन्धित विधेयक जिसमें राज्य का हित प्रभावित होता हो।
ü जब संसद सत्र में न हो, तो राष्ट्रपति को अनुच्छेद 123 के अन्तर्गत अध्यादेश जारी करने की शक्ति दी गई है। संसद के दोनो सदनों में पारित अध्यादेश राष्ट्रपति के अनुमति के बाद अधिनियम बन जाता है। यदि संसद का एक सदन सत्र में हो तो भी अध्यादेश जारी किया जा सकता है।
·            न्यायिक शक्तियाँ (Judicial Powers)-
संविधान  के अनुच्छेद 50 के तहत् कार्यपालिका और न्यायापालिका को पृथक रखा गया है। इसलिए राष्ट्रपति को न्याय प्रबंधन के क्षेत्र में हस्तक्षेप करने की कोई विशेष शक्ति प्राप्त नही है, परन्तु फिर भी राष्ट्रपति को कुछ न्यायिक शक्तियाँ दी गई है।
ü  क्षमादान की शक्ति- अनुच्छेद 72 के तहत् राष्ट्रपति को क्षमादान की शक्ति प्रदान की गई है। अतः राष्ट्रपति किसी अपराध के लिए दोषसिद्ध व्यक्ति को क्षमा कर सकता है या प्रविलम्ब परिहार विराम व लघुकरण कर सकता है। अपनी इस शक्ति का प्रयोग मंत्रिपरिषद् की सलाह पर करता है, परन्तु राष्ट्रपति को यह शक्ति निम्निलिखित मामलों में प्राप्त है।
                                                          i.            जब दण्ड सेना न्यायलय द्वारा दिया गया हो।
                                                        ii.            जब दण्ड संघीय विषय से संबन्धित विधि के विरुद्ध अपराध के लिए दिया गया हो।
                                                     iii.            जब दण्डादेश मृत्युदण्ड हो।
·        वित्तीय शक्तियाँ(Financial Powers)- राष्ट्रपति को वित्तीय क्षेत्र में कुछ महत्तवपूर्ण शक्तियाँ प्राप्त है। राष्ट्रपति प्रत्येक वित्तीय वर्ष के प्रारम्भ में संसद के दोनो सदनों के सम्मु ख भारत सरकार की उस वर्ष के लिए आय और व्यय का विवरण रखवाता है।
·       उसकी आज्ञा के बिना धन विधेयक अथवा वित्त विधेयक और अनुदान मांगें लोकसभा में प्रस्तावित नही की जा सकती।
·       भारत की आकस्मिक निधि पर भी राष्ट्रपति का नियन्त्रण होता है।
·       उसे एक वित्त आयोग नियुक्त करने का भी अधिकार प्राप्त है, जो आर्थिक स्थिति के सम्बन्ध में राष्ट्रपति को परामर्श देता है।
·        सैन्य शक्तियाँ(Military Powers)-  भारत का राष्ट्रपति तीनों सेनाओं का प्रधान सेनापति होता है। उसे युद्ध की घोषणा करने और शान्ति स्थापित करने का अधिकार प्राप्त है। राष्ट्रपति तीनों सेनाध्यक्षों की नियुक्ति करता है।
·        राजनयिक शक्तियाँ (Diplomatic Powers)- भारत का संवैधानिक प्रमुख होने के नाते राष्ट्रपति वैदेशिक क्षेत्र में भारत का प्रतिनिधित्व करता है। विदेशों से सन्धि व समझौते राष्ट्रपति के नाम पर किये जाते है।
·       आपातकालीन शक्तियाँ (Emergency Powers)- राष्ट्रपति को संकटकालीन समय में तीन प्रकार की संकट या आपात की उद्घोषणा करने का अधिकार है।
·       राष्ट्रीय आपात(National Emergency)-  अनुच्छेद-352 के अनुसार यदि राष्ट्रपति को यह लगता है कि युद्ध, बाह्य आक्रमण या सशस्त्र विद्रोह के कारण भारत या उसके किसी भाग में सुरक्षा संकट में है तो वह राष्ट्रीय आपात की उद्घोषणा कर सकता है।आपात की उद्घोषणा का एक माह के भीत संसद द्वारा अनुमोदन किया जाना चाहिए। अनुमोदन के पश्चात् आपात 6 माह तक लागू रहेगा। पुनः लागू करने के लिए पुनः अनुमोदन लेना आवश्यक है।
अनुच्छेद 352 के तहत् अब तक तीन बार राष्ट्रीय आपात लगाया जा चुका है।
1. 1962 में भारत पर चीन के आक्रमण के कारण।
2. 1971 में भारत पर पाकिस्तान के आक्रमण के कारण।
3. 1975 में आन्तरिक अशान्ति के आधार पर ।
·       राष्ट्रपति शासन-  संविधान के अनुच्छेद 356 के अनुसार यदि किसी राज्य के राज्यपाल द्वारा प्रतिवेदन करने पर राष्ट्रपति को लगता है कि उस राज्य का शासन संविधान के उपबन्धों के अनुसार नही चलाया जा सकता तो ऐसी परिस्थिति में राष्ट्रपति शासन लगाकर राष्ट्रपति राज्य का शासन अपने हाथों में ले सकता है। संसद से अनुमोदन के बाद कोई उद्घोषणा एक बार में 6 माह से अधिक समय तक ,कुल मिलाकर तीन वर्ष से अधिक समय तक जारी नही रह सकता।
·       वित्तीय आपात-  अनुच्छेद-360 के अनुसार वित्तीय संकट के समय राष्ट्रपति वित्तीय आपात की उद्घोषणा कर सकता है। ऐसी उद्घोषणा 2 माह के पश्चात् लागू नही रहेगी, जब तक उसे संसद द्वारा अनुमोदित नही कर दिया जाता।
